TERMS OF SERVICE

FoodBite provides a digital platform through which users can discover participating restaurants, browse available menus, and place food orders.

Restaurants listed on FoodBite are responsible for the preparation, quality, description, availability, and packaging of the food they provide, subject to FoodBite's platform policies and applicable law.

The exact role of FoodBite in delivery and fulfilment may depend on the service model applicable to an individual order.

Users must provide accurate information when creating and maintaining a FoodBite account.

You are responsible for maintaining the confidentiality and security of your login credentials.

You must not:

• Create accounts using false identities.
• Impersonate another person.
• Access another user's account without authorization.
• Use FoodBite for fraudulent or illegal activities.
• Attempt to bypass platform security.
• Create accounts to abuse promotions or platform features.

FoodBite may restrict accounts involved in suspected fraud, abuse, or serious policy violations.

When you place an order through FoodBite, the order request is transmitted to the relevant restaurant/seller.

Submitting an order does not necessarily mean that the restaurant has accepted it.

An order may require confirmation by the restaurant according to FoodBite's current ordering process.

Under FoodBite's current workflow, the restaurant/seller may contact the customer before confirming an order.

Customers should provide a valid and reachable mobile number.

If the customer confirms the order, the seller may proceed with confirmation.

If the customer requests cancellation before confirmation, the seller may process the cancellation according to the available FoodBite system.

FoodBite may update its order confirmation workflow as the platform develops.

Where an order is offered on a Cash on Delivery basis, the customer is expected to pay the applicable order amount according to the agreed delivery process.

Customers must not intentionally place fake COD orders.

Repeated fake orders, deliberate refusal without reasonable cause, fraud, or abuse may result in account restrictions.

Restaurants/sellers are responsible for maintaining accurate menu prices.

The final payable amount should be displayed or otherwise communicated through the applicable ordering process.

Prices and availability may change.

In case of an obvious pricing or listing error, the restaurant or FoodBite may contact the customer before fulfilment.

Cancellation availability may depend on the current status of an order.

Customers should use the available cancellation process or communicate with the seller/support where appropriate.

FoodBite and participating restaurants reserve the right to investigate repeated cancellation abuse or fake ordering behavior.

Participating restaurants are expected to comply with applicable food safety and legal requirements.

If you receive food that appears unsafe, contaminated, materially incorrect, or otherwise problematic, you should contact FoodBite Support promptly and preserve relevant evidence where possible.

Customers with food allergies, intolerances, or specific dietary requirements should carefully review available information and communicate directly with the restaurant when necessary before ordering.

FoodBite cannot independently guarantee that every restaurant environment is free from allergens or cross-contamination.

Customers with serious allergies should exercise appropriate caution.

Food images may be provided by restaurants and may sometimes be illustrative.

Reasonable differences may exist in presentation, portion appearance, packaging, or preparation.

However, restaurants must not intentionally provide materially false or misleading menu information.

Delivery times displayed or communicated through FoodBite may be estimates.

Actual delivery times can be affected by:

• Food preparation time.
• Distance.
• Traffic.
• Weather.
• Restaurant workload.
• Delivery availability.
• Incorrect customer addresses.
• Other circumstances beyond reasonable control.

Customers must provide accurate delivery information and remain reasonably available to receive their orders.

Users must not:

• Place fake orders.
• Commit payment fraud.
• Threaten or harass sellers or delivery personnel.
• Use abusive or discriminatory language.
• Submit knowingly false complaints.
• Attempt to hack FoodBite.
• Introduce malware or malicious code.
• Scrape data without authorization.
• Exploit bugs for unauthorized benefits.
• Misuse another person's personal information.
• Engage in any illegal activity through FoodBite.

Serious violations may result in account restriction or termination.

If FoodBite allows customers to submit reviews, ratings, images, comments, or other content, users must follow the FoodBite Content Policy.

Reviews should reflect genuine experiences.

Fake, abusive, illegal, defamatory, threatening, obscene, or misleading content may be removed or restricted.

Customers experiencing problems with an order may contact FoodBite Support through the available support channels.

When reporting an issue, customers should provide accurate information, such as the relevant order number and details of the problem.

FoodBite may request reasonable evidence to investigate certain complaints.

We aim to keep FoodBite available and functional but cannot guarantee uninterrupted operation.

FoodBite may occasionally be unavailable due to maintenance, technical failures, network problems, security incidents, or circumstances outside our reasonable control.

FoodBite may temporarily restrict or permanently terminate access in cases involving serious or repeated:

• Fraud.
• Fake orders.
• Platform abuse.
• Illegal activities.
• Security threats.
• Harassment.
• Policy violations.

Where appropriate, users may contact Support regarding account restrictions.

The FoodBite name, branding, logos, application design, original software, and original platform content may be protected by applicable intellectual property laws.

Users may not copy, reproduce, distribute, or commercially exploit protected FoodBite materials without authorization, except where permitted by law.

Restaurant names, logos, menu images, and third-party materials may belong to their respective owners.

To the extent permitted by applicable law, FoodBite is not responsible for losses resulting solely from circumstances outside its reasonable control.

Nothing in these Terms is intended to exclude or limit any liability or consumer right that cannot legally be excluded or limited.

FoodBite may update these Terms to reflect changes in services, platform functionality, or legal requirements.

The latest version will display an updated revision date.
